, a year and a half now and trying to do a lot of things and trying to avert the fiscal cliff, no plans announced for him to return to washington. the house of representatives, their public stand, the republican leadership at any rate is that it is up to the senate to act. and the president before he left for hawaii last friday pointed out that there is a senate bill. he said he'll try to get a smaller bill and does what he said all along and raise tax rates on those couples filing jointly making more than $250,000 a year and extending unemployment benefits, something that is very important to a lot of americans who have been out of work for a very long time. one problem there, thomas. the very same bill or very near identical bill passed the senate last summer and languishing in the house of representatives. the threshold question has been and remains will the house of representatives stroet do something that a majority of republicans would go against? highly unlikely, thomas, and more and more likely to head over the cliff. for a few days, at least. >> going over the 2012 mike-isms an

are also returning to work out a deal for the fiscal cliff. back to the bay area we are following this story in walnut creek, a person is dead after an officer involved shooting. jackie sissel is live on the scene. >> i am on the 1400 block of creekside drive. the contra costa sheriff's department also remain out here for a shooting that happened a couple of hours ago. here's video from a earlier this morning. we're being told that the 911 called 21453 creekside drive around three this morning. officers got there and apparently shots were fired. one of the suspects were shot and killed and no injuries and cure it occurred to be walnut creek officers. we spoke of the spokesperson for the walnut creek police department and he spoke of the incident. >> we received a call this morning at 315 and there was screaming in the background. officers arrived shortly thereafter. the transmission at three not scene of shots fired. there was an officer involved shooting and all the officers are ok. there is one suspect deceased and there is no one outstanding. we're not looking for anyone and th

fell 24 points. the so-called fear index or the vix, soaring more than 4%. fiscal cliff concerns pushed the index to the highest level since july. one bright spot though was on the housing front. the monthly case-shiller report found october home prices rose 4.3% compared with a year earlier. the data giving a late sign of recovery in the housing market is actually gaining traction. first our top story, president obama, cutting his vacation short, flying back to washington, d.c. tonight to work on a fiscal cliff deal. now, if the stakes weren't high enough, the treasury department upped ante just a short time ago. it announced the u.s. will hit the debt ceiling on december 31st that is monday. treasury department is undertaking and this is a quote, extraordinary measures to postpone the country's date with the debt deadline, but will this bring a new sense of urgency and motivate politicians to reach a budget deal. joining us now, lindsey piegza, economist with ftn financial and james freeman, assistant editor of "the wall street journal"'s editorial page. james, i will start with you.
